The majority of Shoalhaven Council approved the DA to allow:
Demolition of church hall and shed and relocation of church building and reinstatement on site in the location of the demolished shed.
It ruled
1. trees to be protected and retained on the site. [Page 3: 5 (c)] and
2. No approval is granted or implied for any soil disturbance (beyond the movement of vehicles) in any area of the site where ground penetrating radar surveys have not been completed. [ Page 3: 6].
Despite this ruling 6 large trees have been felled and uprooted. The Anglican Church claims this was allowed under the exemption allowed them with the 45-degree rule. Many would say there has been “soil disturbance” too with the uprooting of the trees etc.
